Terms and Conditions of SimpleServiceFinder.com

I. Preliminary Provisions

  1. These Terms and Conditions (hereinafter referred to as the "Terms") set out the rules for using the online platform SimpleServiceFinder.com (hereinafter referred to as the "Service" or "Platform"), operated by SimpleServiceFinder Ltd based in England (hereinafter "Operator" or "we").
  2. By using the Service – including browsing ads, registering an account or using other functionalities – the User (hereinafter "you" or "User") accepts these Terms.
  3. If you do not agree to these Terms, please stop using the Service.

II. Definitions

  1. User – any individual (with full legal capacity) or entity using the Service.
  2. Services – all functionalities, tools and content made available by the Operator on the Service, including browsing and posting ads and/or content.
  3. Content – any materials posted by Users on the Service, e.g., descriptions, photos, comments, contact details, ads, offers.
  4. Paid Services – services or products offered for a fee, e.g., featured ads, ads in special sections of the Service.

III. Acceptance and Modification of the Terms

  1. Legal nature: These Terms constitute a legally binding agreement between you and the Operator.
  2. Age restrictions: Services may only be used by individuals who are at least 18 years old and have full legal capacity, unless otherwise provided by law.
  3. Modifications: The Operator may update the Terms (including the Privacy Policy), e.g., to comply with legal changes or implement new features.
    • In the event of material changes, the Operator will make efforts to notify you in advance (e.g., by email or notice on the Service).
    • Continuing to use the Service after the updated Terms take effect constitutes acceptance of the changes.

IV. Scope and Nature of Services

  1. Advertising platform: SimpleServiceFinder.com is an online platform enabling Users to post and browse ads (e.g., service or product offers) and to contact one another.
  2. No participation in transactions:
    • The Operator is not a party to agreements concluded between Users and does not mediate in determining or performing transactions.
    • All disputes and claims related to the content of ads, their compliance, quality, pricing etc., should be addressed directly to the other party involved.
  3. User risk: By using the Service, you acknowledge that all transactions and interactions with other Users are at your own risk.

V. Registration and User Accounts

  1. Account: Some features of the Service (e.g., posting ads) require account registration. To do so, you must provide accurate and complete information, including a valid email address.
  2. Security:
    • You are responsible for safeguarding your password and login credentials.
    • The Operator recommends using secure connections (SSL/HTTPS) and up-to-date anti-virus and anti-malware software.
  3. Account management:
    • Creating multiple accounts by the same person or using false identities is prohibited.
    • The Operator reserves the right to suspend or close an account in the event of a violation of the Terms, providing false data, or other actions compromising Service security.

VI. User Content

  1. Definition of Content: Includes descriptions, photos, comments, contact details, offers etc. posted on the Service.
  2. Responsibility:
    • By posting Content, you declare that you have the necessary rights (including copyrights) to publish it and that it does not infringe third-party rights or laws.
    • The Operator is not responsible for Content posted by Users, but may remove or block it in justified cases.
  3. Licence: By posting Content, you grant the Operator a non-exclusive, royalty-free licence to process, display, copy and promote it within the Service (e.g., search results, newsletters) and in marketing materials.
  4. Adult content: If Content is intended for adults, it must be appropriately marked and access to it restricted for underage users.

VII. Rules for Using the Service

  1. Prohibited conduct:
    • Violations of law (e.g., content promoting hate, discrimination, violating personal rights or copyrights).
    • Posting vulgar, obscene, misleading or illegal content (e.g., counterfeit products).
    • Impersonating individuals or institutions.
    • Attempts to compromise Service security (e.g., hacking, phishing, vulnerability scanning).
    • Spamming, flooding, DoS attacks, virus distribution, or linking to phishing websites.
  2. Moderation and "Report Ad" function:
    • The Service may include a "Report Ad" button allowing Users to report suspicious or illegal Content.
    • The Operator will take appropriate moderation actions in justified cases (e.g., account suspension, Content removal).

VIII. Limitation of Liability and Disclaimer

  1. "As is" basis: Services are provided as currently available. The Operator does not guarantee that the Service is free from errors, interruptions or defects.
  2. No liability for transactions: The Operator is not involved in agreements between Users and bears no responsibility for any claims, losses or damages arising from published offers.
  3. To the maximum extent permitted by applicable law (including the laws of England and Wales), the Operator shall not be liable for direct, indirect or consequential damages arising from use of the Service. These Terms do not exclude any liability that cannot legally be excluded.
  4. Service interruptions: The Operator is not liable for interruptions due to force majeure, telecom outages or cyberattacks, but will make efforts to restore proper Service function as quickly as possible.

IX. Paid Services

  1. Scope: Basic use of the Service is free, but some additional features (e.g., ad highlighting) are paid.
  2. Fees: Prices for Paid Services are provided before ordering (e.g., on the "Pricing" page).
  3. Payments and taxes: During payment, Users may be asked to accept the terms of an external payment provider. Users are responsible for any applicable taxes or fees.
  4. Violation of Terms: In case of serious violations (e.g., posting prohibited Content), the Operator may suspend or cancel the Paid Service without refund, where justified.

X. Complaints

  1. Complaints: Users may submit complaints about non-performance or improper performance of Services (including Paid Services) within 14 days of the event.
  2. Form: Complaints should be submitted via the contact form, email, or registered mail to the Operator’s address marked "Complaint".
  3. Complaint content: Must include identifying data (name, surname, email), a description of the issue and specific request.
  4. Response time: The Operator aims to respond to complaints within 30 days.

XI. Termination of the Agreement and Account Deletion

  1. By the User: You may stop using the Service and/or delete your account at any time (if such functionality is available), which constitutes termination of the agreement.
  2. By the Operator: The Operator may terminate the agreement or block access if the User seriously violates the Terms, laws, third-party rights, or for valid legal/business reasons.
  3. Consequences: After termination, the account may be removed or blocked, and User Content may be archived, deleted or retained (e.g., as part of a discussion forum).

XII. Final Provisions

  1. Governing law: These Terms are governed by the laws of England and Wales.
  2. Dispute resolution: Any disputes will be resolved by competent courts in England, unless mandatory legal provisions state otherwise (e.g., for consumers).
  3. Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
  4. Privacy Policy: Information on data processing is available in the separate Privacy Policy, which forms an integral part of these Terms.
  5. Binding language: In case of discrepancies between language versions of these Terms, the English version shall prevail (unless otherwise required by law).
